Abstract
Unpublished text from the beginning of the Hegel period in Jena, The German Constitution (1799-1802) analyzed the long process of degradation that the German Empire suffered at the turn of the 19th century and related it to the appearance of a “bourgeois spirit” (Bürgergeist), that is, from an autonomous sphere of interests that was constituted fundamentally under the sign of commerce. We will first try to find some threads of continuity between these elements and the concept of “civil society” in the Philosophy of Right (1820), and then we will enter our fundamental question, the “problem that plagues modern societies”: the social production of poverty and of an inorganic social fringe that acts, even, against the State, the Rabble (Pöbel), trying to understand it as an immanent contradiction of civil society, how Hegel tries to solve it and the historical implications of these solutions.
