THE CLAIM OF A FOOTPRINT IN THE LIGHT OF INTERNATIONAL HUMANITARIAN LAW: ANALYSIS OF THE FALKAND ISLANDS CONFLICT

Abstract
One of the most resounding disputes during the last decades has been the Malvinas-Falkand Conflict, whose claiming framework ?consisted mainly of Argentina´s claims of sovereignty over the islands? has been the reason for many of the resolutions of United Nations. In this sense, the objective of the work that we propose to carry out is to analyze some of the most illustrative episodes of the conflict, in particular those concerning its naval and terrestrial aspects, in order to observe ?according to the account of different testimonies? the violations to the core precepts of International Humanitarian Law that would have been breached by Argentina and The United Kingdom of Great Britain in the course of the dispute. To this end, we are fousing not only on principal treaties of International Humanitarian Law, but also in the significant role that plays international custom in this field of law.
