Abstract
The article presents an account of the institution of amnesty based on the conception of the prerogative of «grace» qua sovereign power that Hegel articulates in his Philosophy of Right. After illustrating its politically problematic character, I examine how the power to grant amnesties, thus understood, can be integrated into a constitutional scheme of division of powers, which requires considering the merit of the usual identification of the «right of grace» with a monarchical remnant. On this basis, the article focuses on the legal-political implications of such a manifestation of the «majesty of spirit» reflecting a «higher» sphere than the one in which its exercise is situated. The inquiry into the function of grace as a (marginal) reflection, at the level of the unfolding of objective spirit, of the full reciprocal recognition in which absolute spirit consists makes it possible to redefine the institution of amnesty as a mark of the finitude of the juridical realm.
