Abstract
The evolutionary interpretation has been gaining momentum in Spain in recent years, not only by restructuring old rights, but by generating new rights. The question arises whether the tool of interpretation relinquishes fundamental rights to the whims of society's majority opinion.We analyze this question in the context of decision STC 198/2012, which reflects how misunderstanding the principle of non-discrimination may contribute to the growth of today's so-called "society of discontent".
